The State Duma Committee approved for the first reading a draft law on the recognition of treason “going over to the side of the enemy” in the context of an armed conflict or hostilities in which Russia takes part.
The United Russia deputies submitted the document to the State Duma at the end of May.
It is proposed to supplement the article on treason (Article 275 of the Criminal Code) with a new corpus delicti: “going over to the side of the enemy in the context of an armed conflict, military action or other actions involving the use of weapons and military equipment, in which the Russian Federation takes part.” In the Criminal Code, punishment under this article provides for 12 to 20 years in prison.
Article 208 of the Criminal Code (“Organization of an illegal armed group or participation in it”) is proposed to be supplemented with part three: “Participation of a citizen of the Russian Federation or a stateless person permanently residing in the Russian Federation in an armed conflict, military operations or other actions with the use of weapons and military equipment on the territory of a foreign state for purposes contrary to the interests of the Russian Federation (in the absence of signs of a crime under the article on treason). For this, it is proposed to punish with imprisonment for a term of 12 to 20 years.
In accordance with the bill, responsibility is also introduced “for carrying out confidential cooperation with special services of foreign states, that is, secretly establishing and maintaining contact with such services or their representatives in order to assist in activities that are knowingly directed against the security of the Russian Federation.” For the commission of such a crime, deputies propose to punish with imprisonment for up to eight years. The fine can be up to 1 million rubles.
In addition, it is proposed to supplement the Criminal Code with Article 280.4, according to which calls to carry out activities directed against the security of the Russian Federation or to obstruct the work of the authorities to ensure the security of the country face a fine of 100,000 to 500,000 rubles or imprisonment for a term of from 2 to 4 years old. Under aggravating circumstances, the sentence can reach up to seven years in prison.
Criminal liability is also provided for the use of mercenaries in hostilities. Thus, the recruitment, training and financing of a mercenary, his use in hostilities, if the law is adopted, will be punished by imprisonment from 12 to 18 years. The participation of a mercenary in the conflict threatens with imprisonment for a term of 7 to 15 years.
