A draft law on the disciplinary arrest of military personnel without trial during the period of mobilization, in wartime and during martial law was submitted to the State Duma. This is stated on the website of the legislature.
The authors of the document, Andrei Kartapolov, head of the State Duma Defense Committee, and Andrei Krasov, his first deputy, propose to give the commanders of military units and the heads of the military police bodies of the RF Armed Forces the authority to apply disciplinary arrest of military personnel without a court decision.
“At present, garrison military courts are located at a considerable distance from the places of deployment of troops involved in hostilities. This state of affairs is unacceptable, especially in wartime, when strict observance of military discipline is one of the main guarantees for the successful completion of a combat mission,” note the authors of the bill.
The current legislation prohibits the commanders of military units from applying such a type of disciplinary sanction to military personnel as disciplinary arrest with detention in a guardhouse. A disciplinary arrest is appointed by a judge of the garrison military court.
