The Minister of the Federal Supreme Court (STF), Kassio Nunes Marques, criticized the “large-scale arrests” ordered by Minister Alexandre de Moraes, which he considered “worrying”.
“At this procedural moment, it seems to me, the large-scale arrests, carried out indiscriminately, due to the facts that occurred on 01/08/2023, investigated in Inquiry No. lead me to set out, right away, some reservations that I consider necessary”, said the minister.
The demonstration was made during his vote against the habeas corpus of a person involved in the coup act on January 8, when Bolsonarists invaded and vandalized the headquarters of the Three Powers, in Brasília.
The minister argued that it is necessary to individualize the penalties against criminals. “On the other hand, arrests in the act and the eventual conversion into preventive arrests or precautionary measures other than prison necessarily require the precise identification of those responsible for the criminal offenses that occurred on 01/08/2023 and the individualization of their respective conduct , in order to characterize the the smoke of the offense committedin addition to demonstrating the specific requirements for granting precautionary custody”, argued the minister.
“I reiterate, (…), my total and vehement repudiation of acts of vandalism against public property, as well as of disrespect and affront to the constituted powers, carried out by numerous participants of the movement that took place in Praça dos Três Poderes on 01/08/2023 “, he wrote.
