Minister Alexandre de Moraes, of the Federal Supreme Court (STF), decided to allow the “immediate return” of Ibaneis Rocha to the position of governor of the Federal District.
Ibaneis had been removed from office after the criminal acts committed by Bolsonaristas on January 8, in the depredation of the headquarters of the Three Powers. At the time, Alexandre de Moraes himself ordered a 90-day suspension, considering that Ibaneis had acted intentionally with omission. The decision, which was confirmed by the other ministers of the STF, would expire on April 9th.
In the decision, the minister claims that investigation reports do not point to evidence that Ibaneis was trying to hinder investigations or destroy evidence.
“The current moment of the investigation – after carrying out several diligences and reports – no longer reveals the adequacy and the need to maintain the measure, as there is currently no risk that the return to public service of the investigated Ibaneis Rocha Barros Júnior may jeopardize the present investigation or result in the reiteration of the investigated criminal offenses”, stated Moraes.
The minister stressed, however, that the inquiry “will follow its regular course, with the carrying out of diligences” and the precautionary measure may be enacted again, if there are reasons for it.
Last week, the Attorney General’s Office (PGR) had expressed itself in favor of Ibaneis’s return to office.
In a note, the governor, who had withdrawn over the last few weeks, said he had waited patiently for his return and that he trusts justice.
“I waited with great patience, resilience and confidence in the Justice of my country, this moment of return to the position that I assumed by the will of the people of the Federal District, who elected me in the first round for a second term. Now it is to remain firm confirming my innocence together with the STF and work even more for the city that I love so much”, said Ibaneis.
In video, the acting governor, Celina Leão, who now returns to the functions of vice-governor, announced the return of Ibaneis and welcomed the governor. “We are together and even stronger, and united, to give the answers in all areas that the population of the Federal District always demands. Welcome, Governor”.
