The court did not support the request of the UOC-MP to ban eviction from the Kiev-Pechersk Lavra during the consideration of the claim.
The Economic Court of Kyiv refused to secure the claim of the Holy Dormition Kiev-Pechersk Lavra of the Ukrainian Orthodox Church of the Moscow Patriarchate against the national reserve Kiev-Pechersk Lavra regarding the invalidity of the unilateral termination of the lease agreement. This was announced by the Minister of Culture and Information Policy Alexander Tkachenko in Telegram, announcing the decision of the court.
“The court refused to secure the claim in the case of the UOC-MP against the National Reserve Kiev-Pechersk Lavra on the invalidation of the transaction on the unilateral refusal of the contract, the application of the consequences of the invalidity of the termination of the contract of July 19, 2013 with religious buildings and other property that is state property,” he wrote.
If the court satisfied the application, the eviction from the Lavra would be suspended until a decision is made on the suit of the church against the reserve.
Recall, on March 10 it became known that the National Reserve Kiev-Pechersk Lavra terminates the lease agreement with the Holy Assumption Monastery of the UOC-MP from March 29. Metropolitan Pavel, viceroy of the Kiev-Pechersk Lavra, said that the monks of the UOC-MP do not intend to move out of the Lavra.
On March 29, the Commercial Court of Kyiv opened proceedings on the claim of the Holy Dormition Kyiv-Pechersk Lavra of the UOC-MP against the apovednik Kiev-Pechersk Lavra about terminating the lease.
The UOC-MP stated that they did not intend to be evicted from the Kiev-Pechersk Lavra until the completion of the trial.
