With the appointment of Flávio Dino (PSB) to the Federal Supreme Court, made this Monday (27), the Lula government begins to evaluate who will be in the Ministry of Justice, one of the main portfolios in the Esplanada dos Ministérios, with a budget of R $20.4 billion predicted for next year.
In this scenario, names such as the executive secretary of the department, Ricardo Cappelli, the lawyer and coordinator of the Prerrogativas Group, Marco Aurélio Carvalho, and the current attorney general of the Union, Jorge Messias, who was also among those listed, appear on the list of those listed. for the vacancy on the Federal Supreme Court.
Names such as Ricardo Lewandowski, lawyer and former minister of the Federal Supreme Court appointed by Lula and even the current Minister of Planning, Simone Tebet, and the leader of the Government in the Senate, Jaques Wagner, a trusted name, are not yet ruled out. by Lula.
The President of the Republic, however, traveled this Monday to the 28th United Nations Conference on Climate Change (COP28), in Dubai, in the United Arab Emirates without giving any indication on the matter. He must still visit three other countries: Saudi Arabia, Qatar and Germany. The PT’s allies believe that it is unlikely that he will announce the next name for the department before Dino’s nomination is approved by the Senate.
The president of the Senate, Rodrigo Pacheco (PSD-MG), announced this Monday (27) that the House must make a concentrated effort to vote on the names of Dino for the STF and Paulo Gonet for the PGR. The two need to have at least 41 votes in the Senate plenary to be approved. Since 1988, no nominee by the President of the Republic for both positions has been rejected.
Another point that will be decisive in defining the next name to occupy the Ministry of Justice is the possible division of the portfolio with the creation of a Ministry of Public Security. In this scenario, Cappelli is seen as a natural candidate to take over Public Security. Among the reasons is his experience in federal intervention in Public Security in DF after the coup acts of January 8, in addition to his work in public security crises in Rio and Bahia.
With this, space could be opened for Lula to accommodate another name in the Ministry of Justice.
The proposal to divide the portfolio was discussed during the government transition and was mentioned again by Lula on October 24th during the “Conversa com o Presidente” program.
“When I ran the campaign, I was going to create the Ministry of Public Security, I’m still thinking about creating it, thinking about what conditions you’re going to create, how you’re going to interact with the issue of state security, because the problem of security is statewide”, said the PT member at the time.
The fact that the ministry currently belongs to a PSB name also weighs heavily on the definition of Dino’s replacement in the ministry. The party was one of Lula’s crucial allies in forming the coalition that emerged victorious in last year’s election by joining vice-president Geraldo Alckmin and, recently, it has already lost ground with the handover of the Ministry of Ports and Airports, which was with Márcio France (PSB), for the Republicans. Both Dino and Cappelli are affiliated with the acronym.
